Welcome to PhotoPea (referred to as "we", "our", or "us"). These Terms and Conditions ("Terms") govern your access to and use of our website at www.photopea.app and the AI image editing services provided through it (collectively, the "Services").
By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Services.
1. User Accounts and Credits
To access certain features of the Services, you may need to register an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
The Services operate on a credit-based system. Credits are used to generate and edit images using our AI models. Credits may be provided free of charge as part of a promotion or purchased via credit packages. Credits are non-refundable and have no cash value.
2. AI Models and Generation
Our Services route requests to various advanced AI models including Seedream, GPT Image, and Nano Banana. While we strive to provide high-quality and consistent outputs, AI-generated results are inherently unpredictable. We do not guarantee the specific outcome, quality, or appropriateness of any generated image.
3. Content Ownership and Use
You retain all rights to the original source images you upload to our Services. For the output images generated by the AI models using your prompts and source images, we claim no ownership. Subject to your compliance with these Terms, you are granted a non-exclusive, worldwide, royalty-free license to use the generated outputs for personal or commercial purposes.
You must not upload or attempt to generate content that violates any laws, infringes on intellectual property rights, contains harmful material, or depicts non-consensual sexual content, violence, or hate speech.
4. Fair Use and Limitations
You agree not to abuse the system, attempt unauthorized access, reverse engineer the AI routing logic, or perform bulk automated queries that bypass our standard user interfaces.
5. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, PHOTOPEA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, ARISING OUT OF YOUR USE OF THE SERVICES.

We reserve the right to modify these Terms at any time. We will notify you of any material changes by updating the "Last Updated" date at the top of this page. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
